Terms of Service

1. The service

Kretaos helps teams organize their client book, log and send omnichannel communications, and work with AI-assisted tools. We may add, change, or remove features over time to improve the product.

2. Eligibility & accounts

• You must be at least 18 and able to form a binding contract, and use Kretaos for business purposes.
• You are responsible for your account, your workspace members, and keeping credentials secure.
• You must provide accurate information and are responsible for activity under your account.

3. Subscriptions, billing & refunds

• Paid plans are billed per seat on a recurring (monthly or annual) basis through Stripe or Razorpay.
• Fees are charged in advance and renew automatically until cancelled. Prices exclude taxes unless stated; applicable taxes are added at checkout.
• You can cancel anytime; access continues until the end of the current billing period. Except where required by law, payments are non-refundable.
• We may change pricing with reasonable notice; changes apply from your next billing cycle.

4. Your data & content

You retain all rights to the client and business data you put into Kretaos (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the service. You represent that you have the right to upload and process this data and to contact the people in it, and that your use of Kretaos — including any outreach — complies with applicable law (including consent, anti-spam, and data-protection rules). We act as your processor for Customer Data; our handling is described in the Privacy Policy.

5. Acceptable use

You agree not to:

• Use Kretaos to send unlawful, deceptive, harassing, or unsolicited bulk messages.
• Upload malware, attempt to breach security, or access data you’re not authorized to.
• Reverse-engineer, resell, or overload the service, or use it to build a competing product.
• Violate any applicable law or third-party rights.

6. Third-party services

Kretaos integrates with third parties (e.g. Google for mailbox connections, Stripe and Razorpay for payments, AI providers). Your use of those integrations is also subject to their terms, and we are not responsible for third-party services.

7. Intellectual property

Kretaos, including its software, design, and brand, is owned by Tamkis and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the service; no other rights are granted.

8. Confidentiality

Each party may access the other’s confidential information and agrees to protect it and use it only as needed to perform under these Terms.

9. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Tamkis will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our total liability for any claim arising out of or relating to the service is limited to the amount you paid us in the twelve months before the claim.

11. Termination

You may stop using Kretaos and close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the service or other users. On termination, your right to use the service ends; you can request an export of your Customer Data within a reasonable period before deletion.

12. Changes to these Terms

We may update these Terms as the service evolves. Material changes will be posted here with a new “last updated” date; continued use after changes take effect means you accept them.

13. Governing law

These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any disputes, unless otherwise required by applicable law.
